RA 11261 First Time Jobseekers Assistance Act

Key points:

  • All Government offices/agencies, without exception, are prohibited from collecting any fees or charges paid in connection with the application for and the granting of licenses, proofs of identification, clearances, certificates or other documents usually required in the course of employment locally or abroad.
  • The benefit may be availed only once.
  • The first time jobseeker is required to present a Barangay Certification stating that the applicant is a first time jobseeker.
  • Falsification of the Barangay Certification results in criminal liability.
  • Government offices/agencies are required to maintain and update a database of all individuals who have been issued documents under this law.
  • The information shall be submitted to the Department of Information and Communications Technology (DICT).
  • There are exceptions to the law, such as those collected in connection with an application to take a professional licensure examination conducted by the Professional Regulation Commission (PRC), application for a Philippine passport authentication and red ribbon of documents from the Department of Foreign Affairs (DFA), application for a Career Service Examination with the Civil Service Commission (CSC) and application for a driver’s license from the Land Transportation Office (LTO).
  • The beneficiaries of RA 10869 or the Jobstart Program and other laws that give similar exemptions for the documents or transactions enumerated under RA 11261, are exempted or are not qualified to avail of the benefits of RA 11261.
  • Any interpretation of the law shall be in favor of the applicant.
  • Non-compliance by any Government office/agency shall result in administrative offense for responsible persons under the Administrative Code and other pertinent laws.
